Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and CareerBuddy Inc., a company incorporated in the State of Delaware, United States, with its registered office at 651 N Broad Street, Middletown, DE 19709, USA ("CareerBuddy", "we", "us", or "our"). They govern your access to and use of Jobs by CareerBuddy, our website, applications, and related services (together, the "Service").
By creating an account, clicking to accept, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated here by reference. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to form a legally binding contract. The Service is not directed to children, and we do not knowingly permit anyone under 18 to register. If you use the Service on behalf of an employer, agency, or other organisation, you represent that you are authorised to bind that organisation to these Terms, and "you" refers to both you and that organisation.
Access is currently invite-only for certain features. We may grant, restrict, or revoke access, in whole or in part, at our discretion and in accordance with applicable law.
2. The two sides of the Service
- Candidates / talent use the Service to build a profile, discover roles, apply, and be discovered by recruiters — quietly and on their own terms.
- Recruiters, companies, and hiring teams use the Service to post roles, search and contact candidates, and manage hiring workflows.
CareerBuddy is a neutral platform that connects these two sides. We are not an employer, an employment agency of record (except where a separate written agreement says so), a party to any employment contract, and we do not guarantee any job, hire, response, salary, or outcome. Hiring decisions, offers, and the accuracy of listings are the sole responsibility of the parties involved.
3. Your account and security
You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Do not share your account or let others use it. Notify us promptly at legal@thecareerbuddy.com if you suspect unauthorised access. We are not liable for losses arising from your failure to keep your credentials secure.
4. Acceptable use
You agree not to, and not to permit anyone else to:
- Submit false, misleading, fraudulent, plagiarised, or impersonating content, including fake profiles, job posts, or references.
- Scrape, crawl, harvest, cache, index, or systematically copy data from the Service, or use bots, automated agents, or AI systems to extract data, except as we expressly permit in writing.
- Reverse-engineer, decompile, probe, or attempt to bypass, disable, or defeat any security or access control.
- Upload malware, or interfere with, overload, or disrupt the Service or its infrastructure.
- Use the Service to harass, defraud, discriminate against, or unlawfully profile any person, or to solicit users for purposes unrelated to legitimate hiring.
- Post roles that are discriminatory, that require illegal fees from candidates, or that are for multi-level marketing, pyramid, or other deceptive schemes.
- Infringe intellectual property, privacy, publicity, or other rights of any person, or breach any applicable law, including data-protection, anti-spam, export-control, and sanctions laws.
- Resell, sublicense, or commercially exploit the Service or data obtained through it without our written consent.
We may investigate suspected violations and cooperate with law enforcement. We may remove content or restrict accounts that we reasonably believe breach these Terms or the law.
5. Content you submit
You retain all ownership of the content you submit — your CV, profile, job descriptions, messages, references, and other materials ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (for formatting), display, and transmit Your Content solely as necessary to operate, secure, and improve the Service and to make it available to the users you intend to reach (for example, recruiters at companies you apply to).
You represent that you have all rights necessary to submit Your Content and to grant this licence, and that Your Content is accurate and does not violate these Terms or any third-party right. If you share another person's personal data (for example, a professional reference), you confirm you have a lawful basis and any required notice or consent to do so.
6. Candidate–recruiter interactions
When a candidate applies to or is contacted about a role, the relevant application content — and, where the candidate has chosen a non-anonymous profile, their identity — is shared with the recruiter for that role. Recruiters must use candidate data only to evaluate and communicate about genuine opportunities, must keep it confidential and secure, must comply with all applicable employment and data-protection laws, and must not retain or reuse it beyond what those laws and these Terms permit. Recruiters act as independent controllers of the candidate data they receive.
7. Fees, plans, and payments
Candidate accounts are free. Recruiter, company, and other paid plans are billed as described on our Pricing page or in a separate order. Payments are processed by our third-party payment provider (currently Stripe); by paying, you also agree to that provider's terms. Unless stated otherwise or required by law, fees are exclusive of taxes, are charged in advance, renew automatically for the stated period until cancelled, and are non-refundable. You authorise us and our payment provider to charge your chosen payment method for all applicable fees. We may change prices prospectively on reasonable notice.
8. Intellectual property
The Service, including its software, design, text, graphics, logos, and the "CareerBuddy" and "Jobs by CareerBuddy" names and marks, is owned by CareerBuddy or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Service under these Terms, we grant you no rights in our intellectual property. You may not use our names or marks without our prior written permission.
9. Third-party links and services
The Service may link to or integrate with third-party sites and services that we do not control. We are not responsible for their content, terms, or practices. Your use of them is at your own risk and subject to their terms.
10. Suspension and termination
You may close your account at any time from Settings. We may suspend or terminate your access, with or without notice, if you breach these Terms or the law, if required to protect the Service or other users, or if we discontinue the Service. On termination, your right to use the Service ends. Sections that by their nature should survive — including sections 5–8 and 11–15 — survive termination.
11. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content, listing, candidate, or outcome is accurate, lawful, or reliable. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, CareerBuddy and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to the Service or these Terms, even if advised of the possibility. Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total fees you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms limits liability that cannot be limited by law (including for fraud, or death or personal injury caused by negligence). Where you are a consumer, these limits apply only to the extent permitted by your local mandatory consumer-protection laws.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless CareerBuddy and its personnel from any claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of your Content, your use of the Service, your breach of these Terms or the law, or your violation of any third-party right. This section does not apply to the extent a claim results from our own wrongdoing, or where it is unenforceable under laws that apply to you as a consumer.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction — except that, if you are a consumer resident in the European Union, Nigeria, or another jurisdiction whose mandatory law gives you the protection of your local courts and law, nothing here deprives you of those protections. We each agree to try to resolve disputes informally first by contacting legal@thecareerbuddy.com.
15. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will give reasonable notice — for example by email or an in-product notice — at least 14 days before it takes effect, unless a shorter period is required by law or to address a security or legal issue. Your continued use of the Service after a change takes effect means you accept the updated Terms.
16. General
These Terms, together with any order and the policies referenced here, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries.
